Harrisburg Shopping is a 'Marketplace Facilitator' as defined in 72 P.S. § 7213(c) and a 'Delivery Network Company' pursuant to 72 P.S. § 7213.1(a) under Pennsylvania law.

Pursuant to 42 U.S. Code § 12181, Harrisburg Shopping is not a “public accommodation” within the meaning of Title III of the ADA, 42 U.S.C. § 12162(2), as we are a purely digital utility, and complaints are generally dismissed under Fed. R. Civ. P. 12(b)(6), a ruling that has been upheld by local County, State, and Federal Courts in Pennsylvania (see Murphy v. Spongellé LLC, 2024 U.S. Dist. LEXIS 12340 (W.D. Pa. 2024), Murphy v. Rolex Watch USA, Inc., 2024 U.S. Dist. LEXIS 84515 (W.D. Pa. 2024), Herrera v. Nike, Inc., No. 2:23-cv-02947 (D.N.J. 2024), and Herrera v. TJX Co. Inc. (D.N.J. 2025)).
